Are ASN and ASB Schemes HARAM?




Ref: SECURITIES COMMISSION DECREES ASN AND ASB SCHEMES NON-SHARIAH COMPLIANT

Assalamualaikum wrt wbt and Salam Sejahtera,

Dear all,
The above matter refers. Kindly take note that the Shariah Advisory Council of Securities Commission has decided that the above-mentioned schemes do not comply with the Securities Commission Guidelines on Islamic Unit Trust Fund. Therefore, pursuant to the said decision, our internal Shariah Committee hereby advise the Bank not to offer any financing for Muslims, that relates to the ASB and ASN schemes purposes. While for non-Muslims, Shariah Committee decision remains unchanged. Attached herewith is the letter from Securities Commission dated 12 February 2009.
This decision will be circularized to all staff in due course.

Perkara-perkara sebegini memang telah banyak berlaku,kerana demi menjaga kepentingan penggubal sesuatu perkara lebih mementingkan kejayaan perkara yang digubal,maka timbullah berbagai pangdangan PERIBADI bukannya hukum dari Quran dan Hadith.Pada permulaan pelancarannya saya pernah berdialog dengan pehak berkuasa ASB dan ASN bab halal haramnya.Oleh kerana mereka tak dapat jawab dengan jelas,mereka jawab NABI PUN BERNIAGA,JADI KITA IKUT SUNNAH NABI....punyalah bahlol jawapannya.HINGGA SEKARANG SAYA MEMANG TAN JOIN PERKARA INI.

Gotta take out my money from there as soon as possible, huhu...

Why lah didn't they inform us about this earlier?

I dont't think they (Majlis Fatwa) didn't notice about this. They admitted about the status of haram but again the reason of "maslahah" or "Dharurah" took place while endorsing their judgment. Any one could explain this "easy use reasoning" that so called "maslahah"?

just imagine if the fatwa council said that ASB/ASN are haram.. Chaos man!

So to be safe I guess they said its harus or permissible so the general unlearned people will take it as "oh okay, ok see fatwa people say its okay, so we just follow what they say"

I believe SC are strict in the rulling which is good for them to hold on!

asb/asn HARAM : Aqad pelaburannya tidak jelas dan tidak jelas samda menuruti ‘Qirad' atau ‘Mudarabah' atau Musharakah. Jika ia menggunakan mudarabah sebagai yang didakwa oleh Majlis Fatwa Perak pelaburan ini disyaratkan menentukan kadar nisbah pembahagian keuntungan seperti 80 : 20 dan sebagainya di awal pelaburan. Namun hal ini tiada dinyatakan langsung di dalam pelaburan ASB.

Perlu disedari bahawa jika sesebuah aqad itu tidak sah dari sudut syara' maka seluruh pelaburan adalah batal tanpa mengira pelaburannya diletakkan di dalam industri halal atau haram.
